‘Agreement’ shall mean the agreement for hiring, signed by or on behalf both the Company and the Primary Contact.
‘Primary Contact’ shall mean the person that registers the Team(s) in the Chinese Community Challenge Cup and any relevant Tournaments.
‘Secondary Contact’ shall mean the person nominated to be the point of contact in the event the Primary Contact cannot be contacted.
‘The Foundation’ means The Frank Soo Foundation and any subsidiary or associated companies, and by the officer authorised to perform any particular duty.
‘Tournament’ Shall refer to any and all Tournaments organised by The Frank Soo Foundation, unless a specific Tournament is specified.
‘Tournament Website' means www.ccccup.com
‘Teams’ and/or ‘Participants’ shall mean the Teams and the individuals in the Teams that are taking part in any and all football Tournaments.
TERMS AND CONDITIONS
Please read these terms and conditions carefully before proceeding to use the Tournament Website and registering your Team. By registering your Team, you will be taken to have read, understood and accepted these terms and conditions, and are agreeing to be bound by them, in the same way as if you had signed a printed version, and they will continue to apply for the duration of the Tournament. If you do not accept these terms and conditions, please do not register your Team. We recommend that you print a copy of these for future reference.
1.1 All Participants must be at least 18 years of age.
1.2 All Team entries are accepted subject to the following conditions of The Frank Soo Foundation (Henceforth known as “The Foundation”)
1.2.1 That all guests are governed by the rules and conditions of all individual establishments involved in the provision of the event of which the booking is associated.
1.2.2 That the use or dealing in any drug form, theft and other criminal acts, vandalism or violence will be dealt with immediately by the police and taken out of our hands.
1.2.3 Any damages, however caused, shall have to be paid for in full and shall be the responsibility of the group leader.

CANCELLATION/LIABILITY
2.1 By The Frank Soo Foundation:
2.1.1 Your attention is drawn to the standard terms and conditions The Frank Soo Foundation are governed by.
2.1.2 The Frank Soo Foundation reserve the right to withdraw at any time any feature as listed in the ‘Tournament Details’ on The Tournament Website.
2.1.3 In the unlikely event that this organisation has cause to postpone an event due to clashes with, for example, but not limited to, Professional football matches, then an alternative Tournament date will be provided. If the client cannot attend the new date, then they will be refunded in full.
2.1.4 We reserve the right to cancel any Tournament/event. In this case, Teams will be offered a refund and/or further participation, in the Super Cup and any relevant Tournaments. Further participation will be dealt with on a case by case basis.
2.2 By the Team(s):
2.2.1 A cancellation after payment shall be linked and governed by the terms and conditions of our contract. Cancellation charges are calculated from the day The Frank Soo Foundation receive written instructions to cancel a booking. Please see below:-

Less than 10 days before start of Tournament: 100% of entry fee non-refundable;

11-24 days before start of Tournament: 50% of entry fee refunded (minus deposit);
-
25+ days before start of Tournament: Entry fee fully refunded (minus deposit).
Please note that all Deposits are non-refundable, unless the event is cancelled by The Frank Soo Foundation.

FORCE MAJEURE
2.3.1 If by reason of force majeure of any kind including but not limited to failure or neglect on the part of any utility supplying electricity, gas or water, labour dispute, strike, civil commotion, war (or threat thereof), act or threatened act of terrorism, fire or explosion, compliance with a law or governmental order, rule, regulation or direction extension or cancellation of the Tournament or any other event beyond the reasonable control of The Foundation, or The Foundation is or anticipates that it will be prevented or hindered from fulfilling the substance of its obligations under this Agreement then The Foundation shall forthwith ensure that the Team’s Primary and Secondary Contacts is aware of the occurrence of any such event and the Team’s primary and secondary contacts shall be entitled at any time thereafter, so long as such cause still subsists, to cancel or suspend this Agreement by notice in writing to The Foundation.
2.3.2 In the event of cancellation or suspension pursuant to clause 2.3.1 above, The Foundation shall be under no liability to the Participants or the Spectators for any loss which they may sustain in consequence of any such cancellation or suspension. The Foundation shall in the event of such cancellation be under no liability to the Teams/Participants in respect of its future obligations under this Agreement and in the event of suspension shall be relieved of such obligations under this Agreement for the period of such suspension.
2.3.3 In the event of abandonment of part or parts of The Foundation’s obligations as aforesaid, The Foundation will not be liable to repay to the Teams any part of the Entry Fee in respect of any period or periods affected by such cancellation or suspension.

PAYMENTS
3.1 All payments should be forwarded to The Foundation, such that they arrive at least three working days before any specified deadline.
3.2 All payments for The Chinese Community Challenge Cup (and any relevant regional Tournaments) are to be in the form of cheques, bank transfer, cash, credit or debit cards. Further instructions will be provided by The Foundation.
INSURANCE
4.1 The Foundation has insurance taken out for public liability to the value of £1 million and employer’s liability to the value of £5 million. It is advised Participants/Teams take out their own accidental injury insurance for any player to player injuries. The Foundation will not be held responsible for any injuries sustained in any of our Tournaments, unless there is an act of gross negligence by a member of the volunteer Team.

ACCEPTANCE OF CONDITIONS
5.1 When entering and paying for your Team’s Tournament entry, you are reminded that you have accepted these conditions on behalf of everyone in your group. All Team members are therefore required to abide by all the conditions in this document.

EVENT DISCLAIMER
6.1 The Foundation will endeavour to ensure all services, amenities and football Tournament events are provided with no omissions.
6.2 However The Foundation cannot be responsible if any service amenity is not provided or any football matches are lost by inclement weather etc.
6.3 The Foundation accepts no responsibility whatsoever for any loss, damage or theft of any vehicle that is left in the venue car parks or surrounding areas. They are left there entirely at the owners’ risk.

VIDEO FOOTAGE & PHOTOGRAPHS
7.1 Video footage and photographs may be taken during the Tournament for (but not limited to) promotional purposes, fund raising applications, photo souvenirs and for our Tournament records. You should write to The Foundation should you wish your child under the age of 18 to be excluded from any photographs and/or filming.

PRIVACY POLICY
We may collect and process the following data about you:
8.1 Information that you provide by filling in forms on our Tournament Website. This includes information provided at the time of registering to use our Tournament Website, subscribing to our service, posting material or requesting further services. We may also ask you for information, for example when you enter a competition or promotion, and when you report a problem with our Tournament Website.
8.2 If you contact us, we may keep a record of that correspondence.
8.3 Details of transactions you carry out through our Tournament Website and of the fulfilment of your entry.
8.4 Details of your visits to our Tournament Website including, but not limited to, traffic data, location data, weblogs and other communication data, whether this is required for our own billing purposes or otherwise and the resources that you access.
Why we may collect your data:
8.5 To send you information packs on your registered Tournaments, or provide you with updates to our Tournaments.
8.6 To send you details of any of our related products/services
8.7 We may also use your data, or permit selected third parties to use your data, to provide you with information about goods and services which may be of interest to you and we or they may contact you about these by e-mail, post or telephone.
8.8 Your data may be used for fund raising applications.
Storage of your data:
8.8 We store personal data in password-protected databases, with access to given to restricted personnel only.
8.9 We do not store credit card details.
Rights for access to personal data

ADDITIONAL TERMS AND CONDITIONS APPLICABLE TO THE CHINESE COMMUNITY CHALLENGE CUP AND ALL RELEVANT REGIONAL TOURNAMENTS
9.0 The Super Cup is an invite only Tournament and there is no entry fee (included in the entry fee in regional Tournaments).To qualify for free entry to the Super Cup, Teams are selected based on several factors including, but not limited to:

Number of regional Tournaments

Number of Teams entered in said regional Tournaments
9.2 All Super Cup entry rules will be provided prior to the start of any Tournament.
9.3 For the Super Cup, there can be a maximum of 4 changes to the Teams selected in the regional Tournaments. This may be increased in exceptional circumstances, but only with the prior written permission of The Foundation.
9.4 All Tournaments are subject to change according to weather, venue availability, satisfactory level of Participants or other factors beyond our control. As such, we may cancel or change any Tournaments, should this be necessary for these reasons. If we do have to cancel a tournament we will offer an alternative opportunity (if available and suitable) but we shall not have any other liability to you.
9.5 You are responsible for arranging and paying for suitable insurance to cover any injury or illness to the Participant as, unfortunately, we cannot provide a refund under these circumstances.
9.6 The location of the venue(s) (both the regional and Super Cup) will be decided by The Foundation. Teams are not required to attend and if unable the Team Manager must inform The Foundation as soon as possible or before the deadline provided by The Foundation.
9.7 The Foundation reserves the right to un-invite any Teams for any reasons it deems necessary. The Foundation will provide confirmation in the event that this happens.
9.8 If a Team does not confirm by the required deadline then The Foundation reserves the right to invite another Team. The original Team forfeits any right to enter the Super Cup if this happens.
9.9 The Foundation is under no obligation to provide transport or subsidise transport in any format. Teams and Participants are responsible for the arranging their own transportation and are responsible for their own safety.
FITNESS
10.1 You must ensure that all Participants are physically fit and able to participate in the sporting activities and accordingly you accept all risks resulting from participation in the course.
10.2 All Participants taking part in all Tournaments will be required to read and sign our health and safety declaration. Participants that do not agree and sign this declaration will not be allowed to participate in any relevant Tournaments.
10.3.We may require additional information depending on the medical information supplied to us by you before we can accept your booking.
10.4 In the event that the Participant needs medical attention during any course you agree that we may provide and/or arrange for any appropriate and necessary treatment.
LIABILITY
11.1 We do not accept responsibility for any death, personal injury or loss of or damage to property other than to the extent that it results from our gross negligence or wilful misconduct.
11.2 The cost of any damage caused by you or any Participant to any property or facilities will be passed on to you.

12.1 Tournament Rules will be provided by The Foundation prior to the start of any and all Tournaments
12.2 Failure to adhere to these rules may result in the Team and all Participants being disqualified in both current and future Tournaments.
